Slip & Fall CasesMy Process

Slip and Fall Accidents in New York

In 2007, more than 7.9 million Americans hurt themselves in a slip and fall accidents. Slip and fall accidents are the leading cause of injury-related deaths among older Americans. Unintentional injuries, which include slip and fall accidents, are the leading cause of death among Americans from the age from one year to age forty-four. So slip and falls are a serious matter.

Slip and fall accidents or trip and fall accidents are the most common type of premises liability lawsuits in New York. Under New York State and local laws, the owners and occupiers of property (e.g., a house, an office building, an apartment building, a store, etc.) have the responsibility to maintain the property in a reasonably safe condition. Slip and fall cases and other premises liability cases arise when the responsible party fails to maintain the property or does something to cause a hazard.

If you have had a slip and fall accident in New York and have questions or believe that you have a slip and fall case, you should consult with a New York slip and fall attorney.  I can help. You can me at 1-800-660-1466 or email me at Carol@SchlittLaw.com. The consultation is free.

Slip and Fall Cases and Trip and Fall Cases in New York

The causes of slip and fall cases are many and varied. I have had clients hurt when contractors failed to clear ice and snow. One woman fell because of uneven bricks on a walkway. Another client hurt herself slipping on a grease skid left behind at a work site. One man tripped over a mound of cement illegally dumped on a sidewalk in Brooklyn. In several cases, I have had clients who slipped and fell on spilled substances in a supermarket. Stairway accidents account for their own category of trip and fall cases as clients have hurt themselves on uneven steps, broken steps and liquids spilled on steps. I even had a case where a worker tripped when squirrels jumped out of a hole in a wall and knocked him down a flight of stairs.

While slip and fall cases may be common, they are among the most difficult cases to win in the New York courts. Why? The courts have been dismissing more and more slip and fall cases before they ever reach a jury and even when they reach the jury, juries look more and more often to blame the victim. That said, I have had good success with slip and fall and other cases when a client trips due to someone else’s negligence. If you think you have a slip and fall or trip and fall case, please call me and I will gladly discuss it with you. A New York Slip and Fall Attorney's Guide: What to Do if You are Injured in a Slip and Fall or Trip and Fall in New York

Take care of any medical needs

See a doctor as soon as possible to treat any medical needs. What may seem like a minor hurt may not go away on its own; when in doubt see a doctor. If you need help finding a doctor, feel free to call me at 1-800-660-1466.

If possible, file a complaint or incident report with the person or organization responsible for your injury

If you hurt yourself in an apartment or office building, notify the building management. If you fell in a store, notify the store manager. Creating a record is important in documenting your case. When you do file a complaint, make sure to write down the name, title and contact information for the person who takes the information. If you have questions on how to do this, feel free to call me at 1-800-660-1466.

Gather Information about the Incident

After you have attended to any medical needs, try to gather as much information as possible about the event. If possible, collect the following information:

  • The exact address where the accident happened

  • The name and address of the owner of the property

  • The name and contact information for the person who takes your complaint

  • The name and contact information for any witnesses

The more information that you can gather in advance, the stronger your potential case will be.

If possible, take pictures of the accident site

If you can take pictures of the accident site, you should do so. Using your camera phone is fine. Photographs can help document the negligent conditions. Also, take photos of your injuries such as cuts, bruises, scrapes, etc.

If appropriate, contact a New York slip and fall attorney

If the slip and fall resulted in a significant injury, you may be entitled to seek compensation. If you think you may have a lawsuit or if you have questions, you should seek the counsel of an attorney experienced in slip and fall cases in New York State.  I have experience with slip and fall and trip and fall cases in New York. Feel free to call me at 1-800-660-1466.
