New York Slip and Fall Attorney
Slip and Fall Accidents in New York
In 2007, more than 7.9 million Americans hurt themselves in a slip and fall accidents. Slip and fall accidents are the leading cause of injury-related deaths among older Americans. Unintentional injuries, which include slip and fall accidents, are the leading cause of death among Americans from the age from one year to age forty-four. So slip and falls are a serious matter.
Slip and fall accidents or trip and fall accidents are the most common type of premises liability lawsuits in New York. Under New York State and local laws, the owners and occupiers of property (e.g., a house, an office building, an apartment building, a store, etc.) have the responsibility to maintain the property in a reasonably safe condition. Slip and fall cases and other premises liability cases arise when the responsible party fails to maintain the property or does something to cause a hazard.

Slip and Fall Cases and Trip and Fall Cases in New York
The causes of
slip and fall cases are
many and varied. I have had clients hurt when contractors failed to
clear ice and snow. One woman fell because of uneven bricks on a
walkway. Another
client hurt herself slipping on a grease skid left behind at a work
site. One man tripped over a mound of cement illegally dumped on a
sidewalk in Brooklyn. In several cases, I have had clients who
slipped and fell on spilled substances in a supermarket.
Stairway
accidents
account for their own category of trip and fall cases as clients
have hurt themselves on uneven steps, broken steps and liquids
spilled on steps. I even had a
case
where a worker tripped when
squirrels jumped out of a hole in a wall and knocked him down a
flight of stairs.
While slip and fall cases may be common,
they are among the most difficult cases to win in the New York
courts. Why? The courts have been dismissing more and more slip and
fall cases before they ever reach a jury and even when they reach
the jury, juries look more and more often to blame the victim. That
said, I have had good success with slip and fall and other cases
when a client trips due to someone else’s negligence. If you think
you have a slip and fall or trip and fall case, please call me and I
will gladly discuss it with you. Feel free to call me at
