If you or a loved one have been injured in an accident as a pedestrian or while riding a bicycle in New York, there are certain steps that you must take and certain steps that I recommend you take. I assume that by the time you read this web page, you have left the scene of the accident and taken care of basics steps such as exchanging information with the driver(s) and attending to any immediate medical needs. Here’s what to do next:

File a Claim for No- Fault Insurance: If your accident occurred in New York, the No-Fault policy of the driver who struck you will cover your immediate medical costs. You need to notify that insurance company of your injuries within 30 days of the accident if you want to be covered. You must also file a Notice of Accident form (the NF-2) with the insurer of the car that hit you. You should submit the NF-2 form within 30 days of the accident to qualify for benefits. Gather Information about Your Accident: If you have not done so and if you can, take pictures of any damage to your bicycle or other property. Take pictures of the accident scene. Take pictures of any injuries your suffered. The more evidence you accumulate, the stronger your case will be.
