NY Landlord Negligence Attorney and NY Premises Liability Attorney

Landlord Negligence CasesLandlord Negligence Process

For many apartment dwellers, accidents can occur at home through no fault of their own, but through the negligence of their landlord. These are not cases involving rent disputes, but ones in which the landlord fails to properly maintain a building or creates a hazard and the landlords actions result in an injury.

If you have been hurt due to the negligence of your landlord, you may be entitled to compensation. You should contact a New York attorney experienced with premises liability and landlord negligence. I will be glad to speak with you and to discuss your rights, answer your questions and help you with a potential case. You can call me at 1-800-660-1466 or send me an e-mail at Carol@SchlittLaw.com. The consultation is free and I will be glad to help you.

NY Landlord Negligence and NY Premises Liability Cases

Landlord negligence and premises liability cases are many and varied. I have had a case when a landlord failed to fix a leak, which ultimately undermined kitchen cabinets that fell on a tenant. In another case, the landlord failed to maintain an apartment and a woman hurt herself stepping through the floor. In one case, a landlord neglected to keep a garbage area clean, which invited rats. My client had a rat bite him on the nose. In another case that resulted in a million dollar award, the landlord harassed a man for refusing to a move out so the property owner could turn the building into co-ops. I have had several cases where landlords neglected to maintain the stairwells in their buildings causing falls by residents or the landlord’s work crews left behind debris that led to an injury for a tenant or a visitor.

I have extensive experience in premises liability and landlord negligence cases and would be glad to assist you if you have a case or think you might have a case. Please call me and I will gladly discuss it with you. There is never a charge for the consultation. Feel free to call me at 1-800-660-1466 or send me an e-mail at Carol@SchlittLaw.com.

A NY Attorney Guide: What to Do if You are Injured Due to Landlord Negligence

Take care of any medical needs:  See a doctor as soon as possible to treat any medical needs. What may seem like a minor hurt may not go away on its own; when in doubt see a doctor. If you need help finding a doctor, feel free to call me at 1-800-660-1466.

If possible, file a complaint or incident report with the person or organization responsible for your injury: If you hurt yourself in an apartment or office building, notify the building management. Creating a record is important in documenting your case. When you do file a complaint, make sure to write down the name, title and contact information for the person who takes the information. Ask for a copy of the incident report. If you have questions on how to do this, feel free to call me at 1-800-660-1466.

Gather Information about the Incident: After you have attended to any medical needs, try to gather as much information as possible about the event. If possible, collect the following information:

  • The exact address where the accident happened

  • The name and address of the owner of the property

  • The name and contact information for the person who takes your complaint

  • The name and contact information for any witnesses

The more information that you can gather in advance, the stronger your potential case will be.

If possible, take pictures of the accident site: If you can take pictures of the accident site, you should do so. Using your camera phone is fine. Photographs can help document the negligent conditions. Also, take photos of your injuries such as cuts, bruises, scrapes, etc.

If appropriate, contact a New York attorney experienced with landlord negligence and premises liability cases: If you think you have been injured due to landlord negligence, you may be entitled to seek compensation. If you think you may have a lawsuit or if you have questions, you should seek the counsel of an attorney experienced in landlord negligence cases in New York. I have experience with landlord negligence cases in New York. Feel free to call me at 1-800-660-1466.
